Canada has introduced new rules for students who have finished their law studies in other countries. They need to follow certain rules as per the common-law system if they wish to Work in Canada .
From March 1, 2026, two additional rules released by the National Committee on Accreditation must be followed by the foreign-trained lawyers. This can help them get approval to work as lawyers in Canada.
The 2 new requirements are :
- Need to prove you are fluent in the language test
- Should take up an additional assessment on Indigenous Law and Peoples
However, along with these new rules, Lawyers trained outside Canada must also finish all the requirements released by NCA. This can help them to practice as a verified lawyer in Canada.
From the article below, we can learn more about how international lawyers can achieve these two new requirements.
Except Quebec, all regions and provinces in Canada operate in accordance with the common-law system.
The National Committee on Accreditation (NCA) is the official body that reviews the education and experience of lawyers trained outside Canada.
Language requirements for lawyers
Applicants who are applying for the National Committee on Accreditation must have finished their language-based exam before waiting for the results. But those already taken this examination can ignore this requirement. But the test must have been taken within the last two years.
Every applicant will be provided only one chance to attend the language test.
This rule is common for everyone. It applies to candidates like :
- Who has taken up the test previously
- Those who reapply after finishing any extra law-related studies
These new changes might affect those who applied before March 1, 2026.
If the candidates choose English, then they must follow the requirements, such as:
- Finish the Versant English test
- Have a minimum pass mark of 61
These requirements are mentioned in the fee structure itself.
For applicants choosing the French language, there is no official language test provided by NCA. So, the applicants must take up the officially approved outside. It will be part of NCA.
Applicants who don't pass the test still have a chance to continue their process. But, upon completion of the language test can help them receive their Certificate of Qualification.
The officially approved language tests and their minimum scores for March 2026 are given below :
English tests
- CELPIP-General 9 in each band
- IELTS General 7 in each band
- PTE Core
- Reading 78
- Writing 88
- Listening 82
- Speaking 84
French tests
Until March 2026, there was no requirement for any applicants to take an additional language test. If they studied law in English or French was acceptable. Only those who did not meet this condition had to provide a language test later.
Indigenous Law and Peoples requirement
According to the new rule, all applicants to the National Committee on Accreditation must have completed a separate course showing their understanding of Indigenous Law and Peoples.
In 2026, a new section 10.5 was added in the manual, which required the applicants to understand the following :
- The history and impact of residential schools
- United Nations Declaration on the Rights of Indigenous Peoples
- The relationship between Indigenous people and the government
- Important ideas like Discovery and terra nullius
- Discrimination faced by Indigenous women, girls, and 2SLGBTQQIA+ communities
NCA suggests the applicants can finish the following requirements by attending a online based examination from either way:
- From the Canadian Centre for Professional Legal Education or
- A course approved by the Canadian law school.
NCA also adds that CPLED is a six-week program that can be finished on our own. This is specifically designed to help lawyers trained outside Canada.
